We want your experience at Heavy Thing (“Auction”) to be positive; therefore, we have developed these specific Auction Policies (“Policies”) for Purchasers to understand their rights and obligations when using the Auction.
These Policies govern all of the Purchaser’s business with the Auction. These terms and conditions apply to every agreement the Purchaser enters into with the Auction. By doing business with the Auction, the Purchaser agrees to comply with and be bound by these Policies.
NOTIFICATION POLICIES & FINAL HOUR REMINDER
Notification System
If you have confirmed your email address, you will automatically receive notifications about the auction’s closing. Notifications are sent 1 hour before the auction ends, with a final reminder 15 minutes before closing time. If your email has bounced, you have unsubscribed, or notifications are filtered into your junk/spam folder, you will not receive these reminders. We recommend adding our email address to your safe sender list and checking your spam/junk folder regularly. Unconfirmed emails will trigger a notice after bidding, prompting confirmation.
Final Hour Responsibility
Regardless of notifications, we strongly advise monitoring the auction during the final hour for last-minute bidding opportunities. Auctions often become competitive as they approach closing. Place your bids early to avoid missing out due to time constraints or internet delays, and be prepared to act quickly as the auction concludes.
GENERAL OBLIGATIONS
Auction Privileges
The Auction reserves the right to temporarily or permanently suspend the Purchaser’s privileges for any reason at any time. Policy violations may result in suspension of privileges across all Heavy Thing business units.
Buyer Registration
You must register by creating an account at https://heavything.com and have an authorized credit card on file before being permitted to bid.
Indemnification
The Purchaser agrees to indemnify, defend and hold harmless the Auction from all liabilities, damages, losses, expenses, claims, suits or judgments, including reasonable legal fees, arising from any Policy breach by the Purchaser or their representatives.
Tampering
Removing, stealing, or tampering with parts is strictly prohibited and will result in legal action.
Investigations
The Auction cooperates fully with all regulatory, government, and police investigations. By doing business with us, you authorize us to provide all relevant documents and information concerning you, your business, and your transactions to any investigating authorities.

AUCTION PROCESS
Auction Details
The Purchaser is responsible for reviewing all information posted on https://heavything.com relating to a listing, including damage estimates, photographs, options, damage descriptions, remarks, and announcements. Listing details are for information purposes only and do not constitute warranties or guarantees. Vehicle options are believed to be accurate but not guaranteed, and listing information is subject to change without notice.
Auction Integrity
You will not use any device, software, or method to interfere with the proper function of the Auction system or website. You will not take actions that impose unreasonable loads on the Auction infrastructure.
Inspection
The Purchaser accepts that all existing and pre-existing conditions of listed assets become the Purchaser’s responsibility. Once the Purchaser has won the auction and the required deposit has been paid and confirmed, the vehicle will be transported directly to the Purchaser. Upon delivery, the Purchaser will have a 10-day inspection period to examine the vehicle. If the vehicle does not match its disclosed condition and the Purchaser discovers undisclosed issues that materially affect the vehicle’s condition or value, the Purchaser may request a refund as outlined in these Policies. Whether or not the Purchaser arranges a third-party inspection during this period, the Purchaser purchases the vehicle in its existing condition and assumes all responsibility post-purchase.
Highest Bidder
Our aim is to sell to the highest approved bidder. The highest bid will be presented with intent to sell. By participating, you commit to purchase if you are the highest bidder or if your bid is accepted. A minimum of three bidders is required. The Auction reserves the right not to sell a Vehicle, and the highest bid does not guarantee a sale.
PURCHASER RESPONSIBILITY
Ownership
Heavy Thing provides no opinion regarding whether items should be purchased or repaired. We are not responsible for post-purchase expenses arising from defects or conditions, whether previously known or unknown. The Purchaser accepts all current and future costs and responsibilities of ownership, including servicing, maintenance, repairs, fuel, licensing, and insurance. The Purchaser acknowledges that expenses will occur post-purchase and takes 100% responsibility for all associated costs. Any advice from service facilities or technicians post-purchase is opinion-based and does not entitle the Purchaser to compensation from the Auction.
Vehicle Safety
For drivable vehicles, it is the Purchaser’s responsibility to ensure compliance with all applicable safety requirements upon taking possession of the vehicle.
Transportation
Once the Purchaser’s deposit has been confirmed, the Auction will arrange transportation of the vehicle directly to the Purchaser. The Auction offers free transport for the first 1,000 km, with a distance-based fee of $1 per km applying thereafter. Typical delivery takes 3–12 business days. All transport is handled exclusively by the Auction; the Purchaser may not arrange their own transport or collect the vehicle directly.
Disclosures
The Auction provides essential disclosure information on vehicles offered for sale, including Mechanical Inspection, Remarks, Damage Estimates and Pictures. The Purchaser must carefully review all disclosures and is strongly encouraged to conduct their own due diligence, research, and vehicle history investigations before bidding. Disclosures are publicly available and subject to change without notice.
Bidding Process

Payment
Upon winning an auction, the Purchaser will be contacted by a dedicated Agent. A deposit as agreed by the Auctioneer will be requested by the Agent to secure the vehicle. This amount will be applied directly to the final purchase price. The deposit must be paid within the timeframe specified by the Agent. Once the deposit is confirmed, the Auction will transport the vehicle to the Purchaser. The remaining balance of the full purchase price is due upon delivery. Upon receipt of the remaining balance, a 10-day inspection period begins. If any payment obligation is not met within the specified timeframe, the vehicle may be released and offered to the next highest bidder or re-sold at the next Auction.
Refunds & Inspection Period
The Purchaser is entitled to a 10-day inspection period commencing upon delivery of the vehicle. During this period, the Purchaser may have the vehicle inspected by a licensed mechanic of their choice. If the Purchaser discovers undisclosed issues that materially affect the vehicle’s condition or value, the Purchaser may submit a refund request to the Auction. Refund requests must include documentation from a licensed mechanic detailing the issues found. Eligible refunds will be processed within 48–72 hours and will include the full purchase price and any transport fees paid. The Auction will arrange return transport at no cost to the Purchaser. If the vehicle matches its disclosed condition and the Purchaser chooses to return it for reasons other than undisclosed issues, the deposit is non-refundable and the Purchaser will bear the cost of return transport.
Title
Title to a purchased vehicle transfers to the Purchaser only after payment in full has been made and all funds have been received by the Auction. The deposit alone does not confer title or ownership rights.
MEMORANDUM OF UNDERSTANDING
By participating in our auctions, I agree to:
- Provide Heavy Thing with identification and permission to retain a copy for verification purposes
- Confirm I am at least 19 years of age with full cognitive ability to make decisions and execute contracts
- Confirm I understand English or have had a translator explain everything to me
- Acknowledge that all items are sold in their existing condition, not contingent on repairs, emissions control, or commercial inspection
- Accept that by purchasing an item, all responsibility (except existing liens) transfers to me
- Understand there is a 100% chance I will spend money on service, maintenance, and repairs during ownership
- Accept that requests for seller reimbursement of out-of-pocket expenses will be declined
- Acknowledge that listing details are believed accurate but not guaranteed and subject to change
- Take 100% responsibility for all costs, including repairs regardless of amount
- Understand the opportunity to purchase an extended warranty where eligible (not available for commercial vehicles) exists only before taking ownership
- Not disparage Heavy Thing or its employees, associates, or partners publicly
- Not seek retroactive price reductions or pursue actions that would harm the company
I understand that breach of these terms may result in liability for damages up to the maximum small claims amount in my jurisdiction.
